Welcome to Nostava. “We”, “us”, and “our” refer to Nostava. Nostava operates this store and website, including the associated information, content, features, tools, products, and services, to provide you with a personalized shopping experience (the “Services”). Our store is powered by Shopify.
These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when using the Services. Please read them carefully, including the disclaimers and limitations of liability. By visiting, interacting with, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Services. Nothing in these Terms excludes mandatory rights you have under applicable consumer law.
1. Access and account
By agreeing to these Terms, you represent that you have reached the age of majority in your state or province of residence and consent to your minor dependants using the Services on devices you own, purchase, or manage. You may need to provide information such as your email address, billing, payment, and shipping details. You represent that this information is accurate, current, and complete and that you have the necessary rights to provide it.
You are responsible for keeping your account credentials secure and for activity under your account. You may not transfer, sell, assign, or license your account to another person.
2. Our products
We make every effort to display our products and services accurately. Colors and appearance may vary with your device and its settings. We do not guarantee that their appearance or quality will meet your expectations or appear exactly as displayed online, subject to your applicable consumer rights. Product descriptions may change without notice at our discretion. We may discontinue products or limit quantities by person, region, or jurisdiction.
3. Orders
Placing an order constitutes an offer to purchase. Nostava may accept or decline it at its discretion. An order is accepted only after our written confirmation, and payment must be received and processed before it is validated. Please check your order carefully before submitting it; cancellation may not be possible once it is confirmed. If we decline, change, or cancel an order, we will attempt to notify you using the contact details provided.
Returns and exchanges are governed by our Refund Policy. You represent that purchases are for personal or household use, not commercial resale or export.
4. Prices and billing
Prices, discounts, and promotions may change without notice. The price charged is the price applicable when you place the order and shown in your confirmation email. Delivery options, charges, and applicable taxes are presented at checkout. Nostava pays import duties on orders placed through our English storefront, as described in our Shipping Policy.
Online prices may differ from prices in physical stores or on third-party platforms. Promotions may have separate terms; if they conflict with these Terms, the promotion's terms prevail. You agree to provide accurate, complete, current purchase, payment, and account information and promptly update your email address and payment details so we can process transactions and contact you.
You represent that your card information is accurate, that you are authorized to use the card, that your card issuer will honor the charges, and that you will pay the displayed price and any applicable shipping, handling, and tax charges.
5. Shipping and delivery
Delivery times provided are estimates, not guaranteed dates. Carrier delays, customs processing, and events beyond our control can affect delivery. See our Shipping Policy for shipping details and help with delayed, lost, or damaged parcels. Any allocation of delivery risk is subject to applicable consumer law and does not reduce mandatory rights.
6. Intellectual property
The Services, including trademarks, text, displays, images, graphics, reviews, video, audio, and their design, selection, and arrangement, belong to Nostava, its affiliates, or licensors and are protected by intellectual property laws in the United States and elsewhere.
You may use the Services only for personal, non-commercial purposes. Without prior written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display or perform, republish, download, store, or transmit materials from the Services, except as permitted by law. These Terms grant no other license or right in Nostava's, Shopify's, or any third party's intellectual property. All rights not expressly granted are reserved.
Nostava's names, logos, product and service names, designs, and slogans are marks of Nostava, its affiliates, or licensors and may not be used without permission. Shopify's marks belong to Shopify. Other marks belong to their respective owners.
7. Optional tools
We may provide access to third-party tools that we neither monitor nor control. Access is provided “as is” and “as available”, without warranties, representations, conditions, or endorsement. We are not responsible for matters arising from your use of optional third-party tools, subject to applicable law. You use them at your own discretion and should understand and accept their providers' terms. Future features, tools, or resources made available through the Services are also subject to these Terms.
8. Third-party links
The Services may include materials, links, or embedded functionality supplied by third parties. We are not responsible for examining their content or accuracy. If you leave the Services to access third-party resources, you do so at your own risk. Subject to applicable law, we are not liable for harm connected with accessing third-party websites or buying or using their products, services, resources, or content. Review their policies before transacting. Questions or complaints about third-party products or services should be directed to that third party.
9. Relationship with Shopify
Nostava is powered by Shopify, which enables us to provide the Services. However, sales and purchases in our store are made directly with Nostava. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Nostava, including damage, injury, or loss resulting from purchased products or services. You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or relating to your purchase and transaction with Nostava, to the extent permitted by applicable law.
10. Privacy
Personal information collected through the Services is governed by our Privacy Policy. Some information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these policies.
Shopify collects and processes information about your access to and use of the Services to provide and improve them. Information submitted through the Services may be shared with Shopify and third parties in countries other than your country of residence to provide the Services. Our Privacy Policy explains how we, Shopify, and our partners use personal information.
11. Feedback
If you submit, upload, post, email, or otherwise provide ideas, suggestions, feedback, reviews, proposals, plans, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, non-exclusive license to use, reproduce, modify, publish, distribute, and display it for any purpose, including commercial purposes. This includes operating, providing, evaluating, improving, and promoting the Services and fulfilling our obligations or exercising our rights under these Terms.
You represent that you own or have all necessary rights to the Feedback, have disclosed any compensation or incentive received for it, and that it complies with these Terms. We are not obliged to keep Feedback confidential, pay for it, or respond. We may, but are not obliged to, monitor, edit, or remove Feedback that we consider unlawful, offensive, threatening, defamatory, obscene, otherwise objectionable, or in violation of intellectual property rights or these Terms.
Your Feedback must not infringe third-party rights, contain unlawful, abusive, defamatory, or obscene content, or include malware. You may not use a false email address, impersonate another person, or mislead us or others about its origin. You are responsible for your Feedback and its accuracy. Subject to applicable law, we accept no responsibility for Feedback posted by you or a third party.
12. Errors, inaccuracies, and omissions
Information on the Services may contain errors or omissions relating to descriptions, prices, promotions, offers, shipping charges, transit times, or availability. We may correct errors, update information, or cancel orders affected by inaccurate information at any time, including after an order is submitted, subject to applicable law.
13. Prohibited uses
You may use the Services only for lawful purposes. You must not use them for unlawful or malicious purposes; violate applicable laws or regulations; infringe intellectual property rights; harass, abuse, insult, harm, defame, intimidate, or discriminate against others; transmit false or misleading information; send or reuse content that breaches these Terms; distribute spam or unsolicited promotions; impersonate another person or entity; or engage in conduct that restricts others' use or exposes Nostava, Shopify, or users to harm or liability.
You must not transmit viruses or malicious code; reproduce, duplicate, extract, sell, resell, or exploit the Services without authorization; collect or track others' personal information; engage in spam, phishing, pharming, or pretexting; use robots, spiders, scraping, data-mining tools, AI tools (including agentic AI), or other automated or manual means to access the Services in violation of these Terms; or interfere with or circumvent security, authorization, robot exclusions, or access restrictions. We may suspend, disable, or terminate your account without notice if we determine that you have violated these Terms.
14. Agents
14.1 These Agent Terms apply if you use, authorize, enable, or cause an Agent to access, use, or interact with the Services. An “Agent” is software or a service acting autonomously or semi-autonomously for, or at the direction of, a person or entity, potentially running on a person's device without direct supervision.
14.2 An Agent may access, use, or interact with the Services only if it continuously identifies itself and strictly complies with section 14.4. An Agent must not do so if we have instructed it to refrain from interacting with any service.
14.3 We may limit, including through technical measures, whether and how Agents access, use, or interact with the Services.
14.4 Agents must identify their requests as originating from an Agent and disclose the Agent's name in every HTTP/HTTPS request by including “Agent/[agent name]” in the user-agent string; must not hide Agent activity by imitating human behavior or bypassing or completing CAPTCHAs or other measures intended to distinguish computers from people; must answer honestly when asked whether interactions are from a human or computer; and must not bypass measures intended to block, limit, modify, or control Agent interactions.
15. Termination
We may terminate this agreement or access to all or part of the Services at our discretion, at any time and without notice, subject to applicable law. Amounts due up to and including the termination date remain payable. Provisions concerning intellectual property, Feedback, termination, warranty disclaimers, liability limits, indemnification, severability, waiver, entire agreement, assignment, governing law, privacy, and any provisions that by their nature should survive will remain effective.
16. Disclaimer of warranties
Information on the Services is provided for general information. We do not warrant its accuracy, completeness, or usefulness. Reliance on it is at your own risk, subject to applicable law.
Except as expressly stated by Nostava, the Services and products are provided “as is” and “as available”, without any express or implied warranty, representation, or condition, including implied warranties of merchantability, fitness for a particular purpose, durability, title, or non-infringement, to the extent permitted by law. We do not guarantee uninterrupted, timely, secure, or error-free use. Some jurisdictions restrict or prohibit these exclusions, so they may not apply to you. Mandatory consumer guarantees remain unaffected.
17. Limitation of liability
To the fullest extent permitted by law, Nostava, its partners, officers, directors, employees, affiliates, agents, contractors, service providers, suppliers, or licensors, and Shopify and its affiliates, are not liable for injury, loss, claim, or direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, revenue, savings, data, replacement costs, or similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from use of the Services or products obtained through them, or related claims including content errors or omissions or loss from content or products made available through the Services, even if advised of the possibility. This limitation does not apply where liability cannot lawfully be excluded or limited.
18. Indemnification
You agree, to the extent permitted by law, to indemnify, defend, and hold harmless Nostava, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers against third-party losses, damages, liabilities, or claims, including reasonable legal fees, arising from your breach of these Terms or incorporated documents, your violation of a law or third-party right, or your access to and use of the Services.
We will notify you of covered claims; failure to notify promptly does not release your obligations unless it materially prejudices you. We may control the defense and settlement at your expense, including choosing counsel, but will not settle a claim imposing non-monetary obligations on you without your consent, which must not be unreasonably withheld. You will cooperate, including by providing relevant documents.
19. Severability
If any provision is found unlawful, void, or unenforceable, it remains enforceable to the fullest extent permitted by law, and the unenforceable part is severed. The remaining provisions continue in effect.
20. Waiver and entire agreement
Failure to exercise or enforce a right or provision is not a waiver. These Terms and policies or operating rules posted by us form the entire agreement governing your use of the Services and supersede prior or contemporaneous agreements, communications, or proposals, whether oral or written, including previous versions. Ambiguity will not be interpreted against the drafting party, except where applicable law provides otherwise.
21. Assignment
You may not delegate, transfer, or assign this agreement or your rights or obligations without our prior written consent. Unauthorized attempts are void. We may transfer, assign, or delegate these Terms and our rights or obligations without your consent or prior notice, subject to applicable law.
22. Governing law
These Terms and separate agreements through which we provide the Services are governed by the federal, state, or territorial laws applicable in the jurisdiction where Nostava has its registered office. You and Nostava consent to the territorial and personal jurisdiction of those courts, subject to mandatory consumer protections and jurisdiction rules that apply to you.

Headings are for convenience only and do not limit or affect interpretation.
24. Changes to these Terms
You can review the current version on this page. We may update, change, or replace parts of these Terms by posting changes on our website. You are responsible for checking periodically. We will notify you of material changes as required by applicable law, and those changes take effect on the date stated in the notice. Continued access or use after changes are posted constitutes acceptance, subject to applicable law.
